1. Introduction
Welcome to Surelity (“the App”), operated by Oksana Omelchenko, Sole Proprietor, located in Kyiv, Ukraine (“we”, “our”, or “us”).
These Terms of Use (“Terms”) govern your access to and use of the Surelity mobile application and related services.
By using the App, you agree to these Terms and our Privacy Policy.
If you do not agree, please do not use the App.
2. Eligibility and Age Restriction
You must be 18 years or older to use Surelity.
If you are under 18, you may not access or use this App.
By using Surelity, you represent and warrant that you meet this requirement and are capable of entering into a legally binding agreement.
3. Nature of the Service
Surelity provides AI-generated symbolic interpretations, reflections, and visual metaphors intended for personal insight and entertainment.
Content is automatically generated using OpenAI technologies (ChatGPT, DALL·E, Whisper).
The App does not provide factual, diagnostic, or predictive information.
Surelity does not claim to foresee or influence future events, and its outputs must not be interpreted as professional or guaranteed advice.
4. Data Use and Third-Party AI Disclosure (Apple 5.1.2(i))
To provide AI interpretations, Surelity transmits user-submitted text, voice input, or contextual data to OpenAI through secure API calls.
This data is primarily used to generate the requested response and may be temporarily processed or retained by OpenAI in accordance with its Privacy Policy and data safety requirements.
We do not sell, rent, or share your personal information with any third parties for marketing purposes.
Before any AI processing occurs, users are informed that their input may be transmitted to OpenAI, and users are informed during onboarding that their input may be transmitted to third-party AI services, and consent is obtained through continued use of the App after such disclosure.
You may withdraw consent at any time by stopping use of the App or deleting your account as described in our Privacy Policy.
5. AI Content Disclaimer
All interpretations, insights, and visual metaphors are generated by Artificial Intelligence and should be regarded as creative content.
They are for personal reflection and entertainment purposes only.
They do not constitute or replace:
medical or mental-health advice,
professional psychological or spiritual counseling,
or any legally or financially binding recommendations.
You agree to use the App at your own discretion and assume all responsibility to the maximum extent permitted by applicable law for decisions made based on AI-generated outputs.
6. User Conduct
You agree not to:
upload or share offensive, unlawful, or harmful content;
misuse or attempt to interfere with the App;
scrape, copy, or redistribute any AI-generated material;
attempt to circumvent payment or access controls.
Violation of these rules may result in account suspension or termination.
7. Payments, Subscriptions, and Refunds
The App offers both auto-renewing subscriptions (monthly/yearly) and one-time purchases (e.g., metaphor packs).
All transactions are processed through Apple App Store, Google Play, or RevenueCat.
Prices are displayed in USD (subject to local variations).
All billing, renewals, and refund requests are managed directly by the respective platform, per their own policies.
Surelity does not process refunds independently.
8. Intellectual Property
All content, branding, UI design, and AI-generated outputs within the App are the intellectual property of Surelity / Omelchenko Oksana.
You are granted a personal, non-exclusive, revocable license to use the App solely for personal reflection.
You may not reproduce, resell, or commercially exploit any materials from the App.
9. Privacy and Data Rights
Your privacy is important to us.
Our Privacy Policy explains what data we collect, how we use it, and how it may be shared with third-party services like OpenAI.
You can request data deletion or withdrawal of consent by contacting support@surelity.com.
10. Limitation of Liability
To the fullest extent permitted by law, Surelity, its owner, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:
use or inability to use the App,
reliance on AI-generated interpretations or visuals,
technical errors or unavailability.
All content is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by applicable law.
11. Termination
We may suspend or terminate access to the App at any time if you breach these Terms or misuse the service.
You may delete your account or uninstall the App at any time.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed under the laws of Ukraine, without regard to conflict-of-law principles.
Any disputes arising from or related to these Terms shall be resolved through binding arbitration or, if unavailable, in the competent courts of Kyiv, Ukraine.
You waive any right to participate in class-action proceedings.
13. Updates to Terms
We may update these Terms periodically.
Changes will be effective once published in the App or at https://surelity.com/legal/terms.
By continuing to use Surelity, you agree to any updated Terms.
